Terms of Service

These Terms of Service govern your use of Velora AI. By accessing or using our platform, you agree to be bound by these terms. Please read them carefully.

1. Service Description

Velora AI provides an AI-powered Instagram automation platform for online stores. Our services include:

  • Automated DM management and AI-generated responses to customer messages
  • AI-powered content creation: posts, reels, stories, and carousels
  • Smart content scheduling and auto-publishing at optimal times
  • Performance analytics, engagement tracking, and weekly briefings
  • Competitor analysis and trending content recommendations (Pro and Business plans)
  • Revenue attribution and sales conversion tracking

By creating a Velora account and connecting your Instagram account, you agree to these Terms in their entirety.

2. Eligibility

  • You must be 18 years of age or older to use Velora AI
  • You must own or be legally authorized to manage the Instagram account you connect to Velora
  • Your connected Instagram account must be a Business or Creator account linked to a Facebook Page — personal Instagram accounts are not supported
  • You must agree to and comply with Meta's Terms of Service, Community Guidelines, and Platform Policies
  • You must not use Velora if you have previously been banned from Meta's platforms for policy violations
  • By using Velora, you represent that all information you provide is accurate and that you have the authority to connect the Instagram account to our service

3. User Responsibilities

  • You are solely responsible for all content published by Velora on your behalf, including AI-generated posts and DM responses
  • You must not use Velora to send spam, unsolicited bulk messages, misleading content, or anything that violates Instagram's Community Guidelines
  • You must not use Velora to engage in fraud, impersonation, illegal activities, or to harass other users
  • You must provide accurate and up-to-date information during onboarding (products, pricing, store policies, payment methods)
  • You are responsible for reviewing AI-generated content before it is published. If you are concerned about accuracy, enable “Approve First” mode in your settings
  • You must keep your Velora account credentials secure and not share them with unauthorized parties
  • You must ensure your store's product and pricing information on Velora remains current and accurate
  • You must comply with all applicable Indian laws and regulations regarding e-commerce and consumer protection

4. Payment Terms

Billing

  • Subscription fees are billed monthly in advance on your billing date
  • Payments are processed via Razorpay (INR) or Stripe (USD) depending on your selected currency
  • All INR prices include applicable GST (18%)
  • Your subscription renews automatically at the end of each billing period unless you cancel

Refund Policy

  • Subscription fees are non-refundable after 7 days from the billing date
  • If you cancel within 7 days of a new billing cycle starting and have not used the service during that cycle, contact us for a refund at support@get-velora-ai.com
  • If you cancel your subscription, you will retain access until the end of the current billing period — no partial refunds for early cancellation

Price Changes

  • Velora reserves the right to change subscription pricing with 30 days advance notice via email
  • Price changes take effect at the start of your next billing cycle after the notice period
  • If you disagree with the new pricing, you may cancel before the new price takes effect
  • Failed payments may result in service suspension after 3 automated retry attempts over 5 days

5. Free Plan

The Free plan provides basic access to Velora AI at no cost, subject to the following conditions:

  • The Free plan is limited to 50 DM replies per month and 5 posts per month
  • All content published under the Free plan will include a Velora AI watermark or attribution
  • Free plan users receive basic analytics only — advanced features require a paid plan
  • The Free plan is provided as-is with no uptime guarantees or priority support
  • Velora reserves the right to modify, limit, or discontinue the Free plan at any time with 30 days notice

6. Account Termination

Velora may suspend or permanently terminate your account if you:

  • Violate any provision of these Terms of Service
  • Violate Meta's Platform Terms, Instagram's Community Guidelines, or any applicable law
  • Use Velora to send spam, engage in fraud, or conduct illegal activities
  • Fail to pay subscription fees after the retry period
  • Provide false or misleading information during account creation or onboarding
  • Engage in abusive behaviour toward Velora staff

In cases of serious violations, Velora may terminate accounts without prior notice. For less severe violations, we will attempt to notify you and give you an opportunity to correct the issue before termination.

Upon termination by Velora for cause, no refund will be issued for any remaining subscription period. Your data will be deleted within 30 days of termination.

You may cancel your own account at any time from Dashboard → Settings → Account. Upon cancellation, you retain access until the end of your current billing period.

7. Service Availability

Velora strives to maintain high availability but does not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for:

  • Service interruptions caused by Meta / Instagram API outages or policy changes
  • Losses caused by temporary service downtime during maintenance windows
  • Changes to Instagram's platform that limit or affect our service capabilities
  • Content not published or DMs not handled during outage periods

8. Limitation of Liability

Velora AI is provided “as-is” without warranties of any kind, express or implied. We do not guarantee any specific business outcomes, including but not limited to:

  • Increases in sales, revenue, or follower counts
  • Specific engagement rates or DM conversion rates
  • Content performance on Instagram

To the maximum extent permitted by applicable law, Velora's total cumulative liability to you for any and all claims arising from your use of the service shall not exceed the total amount you paid to Velora in the 3 calendar months immediately preceding the claim.

Velora is not liable for indirect, incidental, special, consequential, or punitive damages including loss of profits, loss of sales, loss of data, reputational damage, or business interruption, even if we were advised of the possibility of such damages.

9. Instagram & Meta Compliance

  • By using Velora, you agree to comply with all of Meta's Platform Policies, Instagram's Community Guidelines, and any other applicable Meta terms
  • You are responsible for ensuring that your store's use of Velora does not violate Meta's policies on automated messaging, content spam, or platform abuse
  • If your Instagram account is restricted, disabled, or penalized by Meta due to your use of Velora in violation of Meta's policies, Velora is not liable and no refund will be issued
  • Velora operates within the bounds of Meta's official API and does not use unauthorized scraping, unofficial APIs, or methods that violate Meta's terms

10. Intellectual Property

  • Your content: AI-generated content created by Velora specifically for your store (posts, captions, DM responses) belongs to you
  • Velora's IP: The Velora AI platform, technology, brand, logo, and underlying AI models remain the exclusive property of Velora AI
  • License grant: You grant Velora a limited, non-exclusive license to access and process your Instagram data and store information for the sole purpose of operating the service for your account
  • You may not reverse-engineer, copy, or attempt to replicate Velora's platform or technology

11. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of India, specifically the state of Karnataka.

Any disputes arising out of or related to these Terms or your use of Velora shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Bangalore, Karnataka, India.

International users consent to the jurisdiction of Indian courts and acknowledge that Indian law applies to their use of the service.

12. Changes to These Terms

We may update these Terms of Service from time to time. For material changes, we will provide at least 30 days advance notice via email to your registered address and display a notice in your dashboard. The updated terms will include a new effective date at the top.

Continued use of Velora AI after the effective date of updated Terms constitutes your acceptance of the new Terms. If you disagree with changes, you may cancel your account before they take effect.
